This Forum is RESERVED for the posting of COMMENTARY, OPINIONS and EDITORIALS related to the Ancapistan Capital Exchaenge (ACE) operated in Second Life(tm) by the Public Figure (SL: Intlibber Brautigan).

As MODERATOR, here's a word of caution regarding our posting policy here. SL Capital Exchange will NOT tolerate any commentary that is libelous or a defamation of character. To that end, here's a brief legal description of the terms;

What Are Defamation, Libel and Slander?

Generally speaking, defamation is the issuance of a FALSE statement about another person, which causes that person to suffer harm.

Slander involves the making of defamatory statements by a transitory (non-fixed) representation, usually an oral (spoken) representation.

Libel involves the making of defamatory statements in a printed or fixed medium, such as a magazine or newspaper.

What Defenses Are Available To People Accused of Defamation?

The most important defense to an action for defamation is "truth", which is an absolute defense to an action for defamation.

A defense recognized in most jurisdictions is "opinion". If the person makes a statement of opinion as opposed to fact, the statement may not support a cause of action for defamation. Whether a statement is viewed as an expression of fact or opinion can depend upon context - that is, whether or not the person making the statement would be perceived by the community as being in a position to know whether or not it is true.

A defense similar to opinion is "fair comment on a matter of public interest".

Public Figures

Under the First Amendment of the United States Constitution, as set forth by the U.S. Supreme Court in the 1964 Case, New York Times v Sullivan, where a public figure attempts to bring an action for defamation, the public figure must prove an additional element: That the statement was made with "actual malice". In translation, that means that the person making the statement knew the statement to be false, or issued the statement with reckless disregard as to its truth.

The concept of the "public figure" is broader than celebrities and politicians. A person can become an "involuntary public figure" as the result of publicity, even though that person did not want or invite the public attention. For example, people accused of high profile crimes may be unable to pursue actions for defamation even after their innocence is established, on the basis that the notoriety associated with the case and the accusations against them turned them into involuntary public figures.

A person can also become a "limited public figure" by engaging in actions which generate publicity within a narrow area of interest.

Is IntLibber Brautigan on his final days in SL? Surreal has locked his account today and SL has his Brautigan account locked since Oct 20th. This means he started to fall behind on tier payment on the 13th of Oct. LL gives you 7 days to get caught up, then after the 7 days LL locks the account and you have 30 days to get caught up. At this time IntLibber is on his 25th day of being locked out. What will happen if IntLibber loses all his land in SL? Surreal has locked his 12 sims. You can see this here, http://tier.cwcc.com/support/parcel_list.php Now I asked this question on the ACE Forum, and IntLibber responded with this, "I am using IntLibber BnT avatar for official business and have been for several months. I generally take IntLibber Brautigan out of search as a sort of game because it always helps us identify who the ranting idiots are that are trying to smear us" But as we all know he does most of the smearing himself, by not addressing the issue at hand and blaming other for his flaws. Another response I got about my questioning of where is the IntLibber from Stray Underwood stated "And for people who do not understand, you have the option to be removed from search, everyone. So read up on the program and understand it before making pointless claims of frozen accounts." Well I do know the system very well. And I also know that when you take yourself out of search it is out of the web based search, not from under people in SL. I know this because I am not in search but you can still find me in search under people. Now to add to this, if you go under search "all" this is where it takes you out of search. Not entirely out of search but it says this on your profile page: "This resident has chosen to hide their profile from search." As you can see if you search my name "Jimmy Bligh" under all, the second search, since the first is your SL Profile. As you can see for IntLibber Brautigan, he does not show under "people" and the only way out of that is if you are suspended, frozen or banned. If you look under "all" you can compare my account with his and see that he has not taken his name out of search. Also to add to my findings, if you join any of his group on his profile, you will see his profile says he is in the group, but when you look in the group he is not there. There is no way of taking your self out of the group and still have it on your profile. You can only hide your groups from your profile. So with all my findings explained, I'm not here to jut bash IntLibber and say hes banned for non payment; I have shown the facts and proof. So my question is, what will happen to BNT, ACE and another holdings he has? Will this be another bad strike against the financial community? If this does happen will it just happen and be forgot about like Ginko, Tizzy, and Connell? I feel this is as bad as the Ginko, Tizzy and Connell wrapped up into one big explosion, since IntLibber is involved in all 3 parts of the SL Financial World, Land (BNT), Banking (BNTFRE) and Exchange (ACE).

With 13,500,000L$ in the BNT IPO, 4,231,583 L$ in deposits still outstanding on BNTF, and a couple million in ACE IPO and in ACE Deposits. This could be a big problem and the financial community could again get a black mark against it.

So far he has dodged the questions, and then turns it around and bashes anyone that asks questions of his publicly trade company or companies. And yes I understand times re tough in SL, but at least every other company is posting financials and keeping their shareholders in the loop of what is going on.

Thank you for your time and I'm looking forward to hearing every ones thoughts on this issue.

BNT Financial was rolled into BNTRE and securitized with sims so the statement that BNTF has deposits outstanding is incorrect. Could be a pickle if they lose those sims tho.

ACE is independent of BNT so actions taken against BNT won't affect ACE operations. Could complicate things, but not destroy ACE.

BNT does stand to lose it's sims if tier isn't paid and this could be an interesting development. It would just be one of many that are falling these days.

The ACE account that holds the money is owned by IntLibber, This includes all of the BNT last name accounts. If IntLibber owes Linden Lab money they will not allow him to stay in SL with the BNT alt accounts.

Don't worry; this billing failure will not prevent you from logging on with your Second Life account. We will simply try to bill your overdue balance again the next day. If we are unable to collect the amount due within seven (7) days, your account will be suspended pending payment for an additional thirty (30) days. During that time, you will not be able to log in to Second Life. Alt accounts may be placed into administrative hold and you may be logged out of active sessions during this time as well. Failure to resolve this billing issue by the end of the probation period may result in the cancellation of your account. If you have verified the accuracy of your billing information, and are not aware of other outstanding issues that would prevent billing, please contact us through the support portal (https://secondlife.com/support ) as soon as possible.

Upon creation of a Custom Surname, the account designated as owner is billed a $500 Setup fee plus the first annual $500 fee. On each anniversary date, the owner is billed $500 to retain Custom Surname ownership. Last names must clearly be an organizational or corporate name, and distinguished from personal last names. For example, Smith is not acceptable, but SmithCorp, SmithInc, SmithProducts or SmithConstruction are. Names that are clearly composite or made up (SecondLife, Agilent) will be considered.

Second Life Account Holdings: When terminating Second Life accounts, Linden Lab will attempt to sell via the Second Life Auctions any virtual land holdings on the Second Life Mainland. Any money received from such auctions will be applied first to cover outstanding fees or charges due to Linden Lab; any remaining money from the sales will be returned to you. There will be no refunds or exchanges for any unused time on your subscription, Island purchases, Linden Dollars, or in-world objects, items, or content.

The key word there is "may" suspend alt. It's a chunk of SL business they are dismissing there. Suspension of the BNT accounts also causes a huge business interruption which will surely doom BNT, because ACE is not the only BNT holding avatar. I guess it depends on whether LL wants to allow Intlibber to try and solve this issue out or not.

True ACE BNT could be comprimised but that has nothing to do with the website and the rest of the exchange including propietary software. That could be salvaged and reassigned to another alt, or sold off. The question is how much would be lost under the ACE BNT account and would that pay the tier?

There are a million solutions possibilities out there. Been there and done that. Cut, run and eternal damnation for the memes doesn't alway have to be the solution. It is what it is. I'm tired of the sky is falling stuff. Businesses face challenges everyday, some worse than others. It will be interesting to see which way this goes, but I don't think Intlibber is one to give up.

Not to be a defender of Inlibber in this case (why change course now), even though Intibber Brautigan doesn't show up in search, Intlibber BNT still does. If LL was really pissed off about something or thought that some kind of fraud was going on, Intlibber BNT would be shut down by now as well as any other Int alts. (I know this from personal experience with the MECH/YEP mess).

Also I am confused about this Surreal Estates thing. Surreal Estates is not LL is it? So the Inlibber Brautigan avatar is in arrears with Surreal Estates. So what? That doesn't necessarily make BNT enterprises in arrears with LL (just Surreal Estates if they haven't been passing on the tier money to LL). While the defaults with Surreal looks ominous, I guess I am with Ash here that it doesn't necessarily spell doom for ACE or BNT enterprises in general, it just appears bad for for the avatar called Inlibber Brautigan, but his other avatars seem to be ok. Apparently LL doesn't have a problem with all of the other alts because they seem to be alive and kicking even after all this time.

If I am missing the mark here please feel free to correct.

I said nothing about fraud of any kind. I just want to clear that up right away. I said he was he was behind on payment to Surreal, about 12 sims that BNT claims as assets. Also IntLibbler Brautigan is not in the SL system which is an indication of a ban. He has not been in SL since the 20th of Oct as Brautigan. And that is the same time he stopped paying for the surreal sims.

Now when LL suspends an account for non payment they only suspend the main account. And you have 30 days to pay up. If you dont then they take you land and you alts. In this case all of the BNT alts, cause they are owned by Brautigan. Please read the second comment by me for a copy of what LL sends to you and explain what will happen if it is not taken care of.

Does not matter to me one way or another what happens to IntLibber, BNT or ACE. But they are all linked and what happens to one happens to all.

BNT is more than land - It is a full service development company and is engaged in many projects.

BNTFRE is backed by 7 or 8 sims (used to be 10 sims but total outlay of public shares was reduced by the corresponding amount in buybacks). Note that the myriad of other banks that were killed by the banking ban are supported by thin air.

ACE - is completely separate from BNT and BNTFRE. Neither provide income to ACE except the transaction fees due to trades and the advertising fees from folks visiting waiting and wishing for IntLibber's demise.....

If BNT lost sims due to non payment (your speculation and not mine) it could be a temporary blow to BNT. But given LL's policies in the last year I don't know how much of a blow it really would be.

Also I think you are underestimating IntLibber's influence, including within LL. If LL wanted IntLibber to go away, they would have made it happen long before now By the same token, if IntLibber wanted to go away he's had plenty of opportunities to do so long before now.

Without going into too much detail, BNT holds two seperate estates, Surreal BT and Anicapistan.

Surreal BT Estate (where Nolan is Arnaud) is actually physically held by Surreal but managed and branded BNT. It was where BNT started.

Ancapistan Estate (where ACE HQ is located) is physically held by Intlibber.

The bottom line is that Intlibber is a dynamic personality who has challenged a pluthera of problems in the past and this one is no different (however, i still haven't heard this is actually even a problem, only someone who has strung together few things to make a story). I am sure that BNT will survive this and many other issues to come, in one form or another.
