Today, 19:56 system announcement
by Hamncheese Omlet

ACE up for now
ACE is up for now.

All companies are halted in order to keep trading orderly if companies have already decided to relist elsewhere.

Note that if you are a CEO and want your company trading during this time period, you must contact Hamncheese Omlet in Second Life or skype chat at hamncheese.omlet or email at me@hamncheeseomlet.com. I will not answer support tickets at all. The mess that has been created by IntLibber's problems will not be fixed by me without some drastic action by the chairman of ACE.

Also, ATMs are taken offline and will remain so until reopened by IntLibber.

As far as the deal that has reopened ACE, I have offered to host ACE on a fairly unused VPS of mine in order to keep ACE shareholders from having to foot a 114/month US bill (plus late fees).

At this point since IntLibber has no ability to pay, I will continue to host ACE for 6 months starting from today. After which time, the plans of IntLibber and WU should be obvious to all involved.

Be patient as we see if any CEO's are willing to reopen trading on their company. Other than that, the forums are open and CEOs can make announcements, financials etc. You can write support tickets, but I'm sure there is no one that is even looking at them.

Forums are open, that's all that I can offer at this point.

Cheers,

Ham

Ford Edelman Designs (FED) would like to formally announce that it is seeking a relisting from Ancapistan Capital Exchange (AnCapEx) to SL Capital Exchange (SL Capex) pursuant to what we strongly believe as majority shareholder wishes, with management abstaining from the decision process.

Accordingly, we are now entering a formal application process with SL Capex. This will include a FED management review of all existing records pertaining to FED, followed by formal submission of an updated prospectus and completion of SL Capex compliant financials. Barring any unforeseen issues formal documentation will be submitted to SL Capex by end of day Sunday, December 6, 2009 for approval and acceptance.

Some of you may, or may not, be aware that Ancapistan Capital Exchange plans to begin operating within a week. I have asked that ALL trading of FED shares at AnCapEx be halted prior to the exchange re-opening.

The decision to relist FED was based on three factors:

- My perception of shareholders intentions shortly before the second lapse of the ACE platform, where a popular vote was displaying a 20 to 2 vote in favor of relisting (with management abstaining from the vote)

- Significant absence and neglect of the business and platform by its leading principal, with no guarantee that a strong management will be in place at the exchange reopening.

- No confirmation that, once reopened, the exchange capitalization would sustain a sufficient level of withdrawals by our shareholders.

That said, Ford Edelman Designs wishes ACE the best in going forward as it rebuilds the business and recapitalizes the exchange. ACE has full FED, as well as my personal, support.

Ladies, Gentlemen and Avatars of all kind – THANK YOU for your patience as we enter the transition period and begin rebuilding our company. As always, our historically consistent monthly dividend practice will continue, which is now 20+ months in continual practice.

All the best,
Ash Wade

The Caldbeck land location teir was contributed by Scott Nestler who offered to help if he could. I suggested that he could do that to help as there currently not much else we could do. Just wanted to take a moment and share the little light of information that I can provide to traders that had been involved with ACE as I believe that is of course your right.

I agree not all were refunded, correct. As many have not been online for some time during that time.

I did leave behind far more value in assets than the balance due to some investors. The land and assets were to continue on longer than the 1 month that it did live on.

I was out of SL 1 month when Intlibber took everything and gave the investors nothing. If he had combined all assets and sold them off and split with all investors, it would have been better for all.

http://ace-exchange.com/home/story/CGF/8

"Proceeds of this liquidation amounted to approximately 1.6 million L$ at an average price of 6.5 L$ per square meter, slightly above SL average sale prices for the month. Capital from these sales went into several major projects of BNT: The Ancapistan Capital Exchange and http://www.ancapex.net, as well as the complete revamping, replacement, and rebranding of My Second Bank into BNT Financial (http://www.bntfinancial.com), as well as the further development of bntholdings.com, and the merger of Global Credit into BNT."

He never should have got his hands on any of the assets, that was never part of the plans at all.

---------------- from sl-newspaper -

Here is what IntLibber Brautigan, CEO of BNT, has to say about how it came about. “Madelena Rossini had gotten Jasper to propose a merger, back when most people other than myself had no clue what BNTs finances were and people thought we were in financial trouble. Jasper thought then that BNT would be merged into CGI, not the other way around, and that probably would have been the case if he had not kept up his irresponsible policy of no withdrawal limits during the banking crisis. After the public had drained L$10 million from The Bank, it was a different story. We had discussed it a bit more, but then he left and Patrickj Ah took over and he and I negotiated and completed the deal we have today.”

KEY part = "he left and Patrickj Ah took over and he and I negotiated and completed the deal we have today.”

----------

Yes i was going to buy out BNT the week I quit SL... Madelena Rossini told me she was net getting paid from BNT for her work there, and all the land was about to go offline, but to cover Intlibber tier was not what I wanted to do, and with all LL issues at the time, and the opensim grid software, I choose to quit. And paid the 10 million L$ to depositors not to the BNT intlibber bailout.

But as you read, he made the deal anyway, this time he took over CGI not CGI bailing out him... Where did he get money to buy CGI and all the assets?

OH>>> BNT stock.. yes he gave the investors of the land management company shares.. lmao

This BS has been in my life too dam long now, if you have some real facts other than what is in the sl-newspaper get it.

Anyone Who knew intlibber would see this is 100% the way he did business, and he threw me under the bus to do it.

Read the sl-newspaper, I quit SL to make a new grid, and I did that!! And it is a success today!

I said back in 2007 to Tobia at vstex to give all my stocks in all my companies to the next highest shareholder, who also was president of my company. I left L$ millions and 260,000 sqm mainland all rented land that was making money.

1 month after I left the deal was made to merge it all into BNT and BNT then sold off my assets left behind and used the money to start ace exchange umong many other things

Intlibber admited to it all on his website. Which is down now....

Pay people back? I gave out 10 million L$ the week I quit SL.

http://www.intlstockexchange.com/displaypressrelease.php?noheader=1&releaseid=231

"09.01.07 - The Bank fulfills its committments

After a cordial conversation with Jasper Tizzy of The Bank, PLTs CD of $2 Million was paid back in full.

I would like to personally thank Mr Tizzy and all the staff at The Bank for their outstanding service. They have always fulfilled its obligations, and I wish The Bank and AVC the very best of luck in the future.

Rodder Holgado "

Want to see more? Do you repeat everything you hear?

People were yelling they lost money with the bank, why? to get Rock Insurance. They were people who had zero money invested.

Rock sold insurance to 1 day old noobies over and over.

Look at the facts:

I quit, yes
I gave everything to the next shareholder

Patrickj got into a deal with Intlibber to take my 2 companies and only keep one, the one the land was in. Not the one the bank was in. SO the bank investors should have had the land and all other stocks and assets left behind, when they decided to sell it all off.

I was not in SL and this happened after I was gone. Intlibber took all assets in a merger with BNT and sold it all fast to pay his tier. And I was in Sl-Newspaper yelling it was not fair and to not allow it. But the vote 86% was all from one guy, patrick j the one with all my assets of all my companies.

It was a loop hole for them to say we only want the group with the land not the group with the investors, and then I am called a scammer, for what?
I was gone a month when that happened.

Get your story straight, I have been fighting this LIE for 2 yrs and have now lawyers ready to take action on any new claims.

In a scam the person with the money is the scammer, dont you realize intlibber sold all my assets and used the money to make ace exchange and pay tier??

Please read the facts.. dont get me going here, I come here in good faith and do not want anything from anyone. I have a great system i have made outside of SL and thats it.

----- read this from sl newspaper about patrickj ah words.....

Ah then went on to outline the options that he had prepared. “Our choices at this stage are: Sell all the CGI land and distribute the proceeds as a dividend to the shareholders; or, Merge with BNT.” Ah stated that Brautigan & Tuck holdings has offered a merger in which CGI shareholders would receive 2 shares of BNT stock for every 3 CGI shares tendered. He also voiced a proposal that CGI, AVC and The Bank be considered a single entity and that any proceeds be distributed among the shareholders of all three companies. “I saw this person’s point,” Ah concluded. “However, I am not in favor of that.”

What is important there? Can anyone READ....

He also voiced a proposal that CGI, AVC and The Bank be considered a single entity and that any proceeds be distributed among the shareholders of all three companies. “I saw this person’s point,” Ah concluded. “However, I am not in favor of that.”

NOT IN FAVOR OF BEING FAIR? WTF and you call me what?

Patrickj had 86% of CGI, and CGI is only the group holding land and collecting the rent on the 1.27 million sqm mainland at the time.

The plan was to keep collecting the rent, I was told to pay off people with the cash reserves we had, then sell off land to get tier lower that he could afford to pay.

I left 1 month later Intlibber needed tier and made a deal to sell it all and KEEP all the money.

So please dont call me a scammer, you dont know mw and I have an army of people in AH Grid now that can prove I never scammed anyone in the past 2 yrs, and I have helped many the past.

However, there is a silver lining and I think that is basically what this thread is all about I must admit. I suppose there are many things that can be done. We do have 3 good solid exchanges as Alain points out and maybe if they combine together and somehow keep ACE from coming back again or collectively buy it out, maybe Intlibber can be silenced for good. I agree with you about Luke, but I still think that he will attempt to tie into SL somehow or other since it had been a lucrative market for him in the past and as new people come in it is a possible source of revenue in the future. And I am sure that Allan and others are lurking out there under different names and we have to be watchful for that as well, but at least they aren't making any noise, yet. If they have come back to earn money to pay back the people they owe then I support them, just as long as they aren't screwing newer people to make their restitution, but that's a whole 'nother topic.

I guess what needs to be done is that the current good exchanges become "louder" than the bad guys. Maybe then we can get this sector back on track and make it fun and interesting again. I think it is up to the 3 good exchange owners to collectively work together towards a goal of leading the SL community in a trustworthy and lucrative enterprise.

As far as VWBIZX is concerned, this is the first I've heard of it. Is that the old Dreamland exchange, or is this something that has popped up from Open Grid with our good friend Jasper Tizzy? I will definitely be googling this when I get the chance.

Thanks for hearing me out and I wish us all a good and beneficial future.

<![CDATA[ Re: OP/Ed and Commentary re; ACE - Ancapistan Capital Exchange]]> http://slcapex.com/forums/topic/general/2154
I dont think you will see the death of Intlibber, just as I don't think you will see the death of Jasper Tizzy, nor of Inv Allen. Those avatars may go, but those people will remain, and will continue to reincarnate in some form or fashion.

The concern is that none of these people displayed any sense of warning, caution, or follow through when thier companies were not doing well. In each case it appears investors were lied to on a continual basis. This pattern of behavior is selfish, wreckless and causes mistrust. There is no need to lie when times are bad. It is what it is.

So how are we going to be smarter and more innovative to preserve our industry before one of these people really ruins it for the group? The problem is that in each case I've seen acting before thinking, and ignoring rather than anticipating issues. Eventually it may come to a point where LL decides to hatchet the whole marketplace altogether.

WSE to me is a null and void risk for us. Luke wants nothing to do with SL from what I can tell.

The more concerning issue is VWBIZX. That is a rabbit hole that goes deep, and it's not just as simple as "another exchange". We are talking an exchange that connects to another virtual world and another economic system. The concerning issue to me is that the people running the exchange run the economic system (G$), and also run the virtual world in which it operates. I am missing where there are any checks here and who is managing it. It's a free reign on printing virutal money akin to if LL wanted to open an exchange. There needs to be some thought given to what the risk and implications of this will be.

The WSE and ACE were the ones creating the most noise, but i think in business and in life in general the ones who can keep on going with a quiet hum and without much fuzz around it make it the longest.

As i stated on ISE today, i am pretty happy about the three exchanges right now, and especially ISE and SLCAPEX where management seems to have things under control. I hope this steady going continues and we as a community learn to assess the risks more better and making this financial community a viable one. We do not need the so called "high profile" folks to run the show. It's not a circus, it should be a community of thought and vision and quiet calculation. With thought-through decisions and long-term management.

So i see a lot of positive growing from this.

A topic which concerns me though, is the situation developing over at the WSE again and the new VWBIZ or whatever it is. I am just surprised that no one has taken any legal action against Luke till this day and that he is able to promote his shit on Facebook. If no one will then i for one will at some point start telling the story on facebook about Luke and his antics.

Yes, it will.

Why? 2 reasons:

1) Good scammers are always coming back
2) ACE is the only real asset Int. owns. Is a real platform with a nice list of investors

I do not believe ACE site is down because of lack of payment. It would be crazy. The amount is so small that even someone broke could afford it. Especially when the asset as a bigger value….

Int is playing a game-plan. In my opinion he is evaluating 2 options:

1) Selling ACE to another scammer
2) Make an association with another scammer

Why keeping the site down? To clean up a lot of problems he has…. Like an empty ATM and a lot of unpaid debts. When he or the new association will be back, be ready of a lot of accusation to everybody (Int. style).
He is going to make his usual false accusations: Communist, Fascist, North Korean President, etc, etc. Ah…. Of course me! :-)

Now, who is going to be a possible candidate for an association or a buy out? Shaun, maybe……

Who knows, will see…..

Why am I afraid? Intlibber, in my opinion, represented everything that was wrong with SL Finance. I also believe the same of Luke Connel whathisname (sorry my spelling is bad news tonight as is my memory), of WSE fame. But since those two have been the "face" of SL Finance for quite a while ( who in the heck remembers Investor Allen, Investor Merlin, or whatever), by virtue of the fact that they have been the "loudest" and most obnoxious, then with their "deaths" we, as a financial community, may not be able to survive much longer. It is up to the surviving exchanges to turn the tide and I don't see that as an easy task, not necessarily impossible, just not easy. It could probably be done with a lot of creativity and perseverance. Without that effort, however, then I am thinking that the SL owners will decide that they need to shut down our sector just like they shut down gamblng and banking for fear of bad press or whatever reason they decide they want to come up with.

Forgive me, I am depressed tonight and I can't even offer a possible solution. I hate to just be bitching about a problem without offering a possible solution but in this case I have no ideas. Maybe this is something others can get behind and tell an old dude (me) to wander off into the valley of happiness and then they can start taking some action to save our sorry asses without the old dude(s) interfering. :).

We generally do not comment on pending listings until they are published, however, if indeed ACE has drawn its last breath you could certainly anticipate that at least one or two of the better listed co's there would seek relisting here. I know a handful are actively seeking comment at ISE - our process is different.

Historically we've not actively recruited co's listed on other exchanges but prefer to consider co's that truly want to be part of the CapEx community. Realistically, very few of the ACE listings would pass our underwriting scrutiny - that's how several of them ended up there to begin with.

Stay tuned...

The BNT/ACE Fiasko
Dear Investors,

Due to some incorrect details being spread by IntLibber Brautigan, here is Skype chat log with IntLibber, irrelevant discussion has been removed and my Skype account name changed which relates to a business we do not own. Date are on european format: DD.MM.YYYY

Actual conversation has zero modification, including all typos etc.

This posting is made solely on the purpose that you may draw your own conclusions of the situation, without any personal agenda of anyone who's involved being affection to the situation.

Also, i remind you that i never claimed IntLibber has sold our sims to WU, only being afraid of that due to no communication what so ever. Furthermore, IntLibber has never said anything about requirements to getting sims moved.

Our sims are being held by Vitall Beck who has shown to be far greater, independant security for shareholders than any current exchange regulation, just look at the KUSH Islands management over at SLCapEx. We wanted to transfer the two sims to her aswell. As a shareholder, i need to ask you to consider which is better for you: Exchange held with arbitrary rules, or an Individual shareholder secured which has an financial interest on the well being of the company and proven track record to make good for shareholders?

Please voice your opinion here on ACE forums, to us and to ACE management.

Why did we go public? Simple: No communication what-so-ever, no answers at all. When going public, i knew the only thing IntLibber really cares about is publicity. Our publicity was met with the usual slander allegations, pretty much as expected.

Also, SLIB is the only still standing large-scale virtual bank, all the competition from back-the-day is completely gone, and most of them left huge amounts of depositor funds unpaid. As far as we know, only one of them made good to 100% of the depositor funds, and in question was a small scale operation known as SL Bank. During the banking ban, SLIB was the second largest in terms of deposits, despite being one of the smallest in terms of sheer volume of different depositors(accounts).

This whole thing is taking away time from more important tasks, and hope the situation clears out soon.

Here is conversation with IntLibber first, then with Cliff Eclipse.

** Open Letter to IntLibber Brautigan
Dear Michael Lorrey aka IntLibber Brautigan,

I'm saddened that i need to make public announcement to get anything done, despite even YOUR employees trying to do all they can to get you to act.

I'm delighted to notice that after several months, you made the requested Estate Manager changes.

However, another issue remains unresolved, and that is the requested sim transfer tickets, as spoken several weeks ago with you on Skype. The reasoning was explained to you on plain terms, and as explained, are closely related to your own personal and/or business problems with Linden Lab.

I'm requesting you to again, please, issue the transfer tickets and send us the ticket numbers.

I'm also saddened to notice that you took time to reply to 3rd parties about the issue of our sims, in detail, but not even as much as a reply to us.

I hope your dealings with Woodbury University goes well despite this public fiasko.

Best Regards,
Tyrian Camilo

Surreal BT Estate (where Nolan is Arnaud) is actually physically held by Surreal but managed and branded BNT. It was where BNT started.

Ancapistan Estate (where ACE HQ is located) is physically held by Intlibber.

The bottom line is that Intlibber is a dynamic personality who has challenged a pluthera of problems in the past and this one is no different (however, i still haven't heard this is actually even a problem, only someone who has strung together few things to make a story). I am sure that BNT will survive this and many other issues to come, in one form or another.

<![CDATA[ Re: OP/Ed and Commentary re; ACE - Ancapistan Capital Exchange]]> http://slcapex.com/forums/topic/general/2154
BNT is more than land - It is a full service development company and is engaged in many projects.

BNTFRE is backed by 7 or 8 sims (used to be 10 sims but total outlay of public shares was reduced by the corresponding amount in buybacks). Note that the myriad of other banks that were killed by the banking ban are supported by thin air.

ACE - is completely separate from BNT and BNTFRE. Neither provide income to ACE except the transaction fees due to trades and the advertising fees from folks visiting waiting and wishing for IntLibber's demise.....

If BNT lost sims due to non payment (your speculation and not mine) it could be a temporary blow to BNT. But given LL's policies in the last year I don't know how much of a blow it really would be.

Also I think you are underestimating IntLibber's influence, including within LL. If LL wanted IntLibber to go away, they would have made it happen long before now By the same token, if IntLibber wanted to go away he's had plenty of opportunities to do so long before now.

Cheers,
Ham
(note that I'm no longer affiliated with ACE/BNT so take my observations with a grain of salt)

Now when LL suspends an account for non payment they only suspend the main account. And you have 30 days to pay up. If you dont then they take you land and you alts. In this case all of the BNT alts, cause they are owned by Brautigan. Please read the second comment by me for a copy of what LL sends to you and explain what will happen if it is not taken care of.

Does not matter to me one way or another what happens to IntLibber, BNT or ACE. But they are all linked and what happens to one happens to all.

Also I am confused about this Surreal Estates thing. Surreal Estates is not LL is it? So the Inlibber Brautigan avatar is in arrears with Surreal Estates. So what? That doesn't necessarily make BNT enterprises in arrears with LL (just Surreal Estates if they haven't been passing on the tier money to LL). While the defaults with Surreal looks ominous, I guess I am with Ash here that it doesn't necessarily spell doom for ACE or BNT enterprises in general, it just appears bad for for the avatar called Inlibber Brautigan, but his other avatars seem to be ok. Apparently LL doesn't have a problem with all of the other alts because they seem to be alive and kicking even after all this time.

If I am missing the mark here please feel free to correct.

Thanks.

True ACE BNT could be comprimised but that has nothing to do with the website and the rest of the exchange including propietary software. That could be salvaged and reassigned to another alt, or sold off. The question is how much would be lost under the ACE BNT account and would that pay the tier?

There are a million solutions possibilities out there. Been there and done that. Cut, run and eternal damnation for the memes doesn't alway have to be the solution. It is what it is. I'm tired of the sky is falling stuff. Businesses face challenges everyday, some worse than others. It will be interesting to see which way this goes, but I don't think Intlibber is one to give up.

-----------------

The ACE account that holds the money is owned by IntLibber, This includes all of the BNT last name accounts. If IntLibber owes Linden Lab money they will not allow him to stay in SL with the BNT alt accounts.

Don't worry; this billing failure will not prevent you from logging on with your Second Life account. We will simply try to bill your overdue balance again the next day. If we are unable to collect the amount due within seven (7) days, your account will be suspended pending payment for an additional thirty (30) days. During that time, you will not be able to log in to Second Life. Alt accounts may be placed into administrative hold and you may be logged out of active sessions during this time as well. Failure to resolve this billing issue by the end of the probation period may result in the cancellation of your account. If you have verified the accuracy of your billing information, and are not aware of other outstanding issues that would prevent billing, please contact us through the support portal (https://secondlife.com/support ) as soon as possible.

Upon creation of a Custom Surname, the account designated as owner is billed a $500 Setup fee plus the first annual $500 fee. On each anniversary date, the owner is billed $500 to retain Custom Surname ownership. Last names must clearly be an organizational or corporate name, and distinguished from personal last names. For example, Smith is not acceptable, but SmithCorp, SmithInc, SmithProducts or SmithConstruction are. Names that are clearly composite or made up (SecondLife, Agilent) will be considered.

Second Life Account Holdings: When terminating Second Life accounts, Linden Lab will attempt to sell via the Second Life Auctions any virtual land holdings on the Second Life Mainland. Any money received from such auctions will be applied first to cover outstanding fees or charges due to Linden Lab; any remaining money from the sales will be returned to you. There will be no refunds or exchanges for any unused time on your subscription, Island purchases, Linden Dollars, or in-world objects, items, or content.

ACE is independent of BNT so actions taken against BNT won't affect ACE operations. Could complicate things, but not destroy ACE.

BNT does stand to lose it's sims if tier isn't paid and this could be an interesting development. It would just be one of many that are falling these days.

<![CDATA[ Could this be the final straw, that breaks the financial community?]]> http://slcapex.com/forums/topic/general/2154
Is IntLibber Brautigan on his final days in SL? Surreal has locked his account today and SL has his Brautigan account locked since Oct 20th. This means he started to fall behind on tier payment on the 13th of Oct. LL gives you 7 days to get caught up, then after the 7 days LL locks the account and you have 30 days to get caught up. At this time IntLibber is on his 25th day of being locked out. What will happen if IntLibber loses all his land in SL? Surreal has locked his 12 sims. You can see this here, http://tier.cwcc.com/support/parcel_list.php Now I asked this question on the ACE Forum, and IntLibber responded with this, "I am using IntLibber BnT avatar for official business and have been for several months. I generally take IntLibber Brautigan out of search as a sort of game because it always helps us identify who the ranting idiots are that are trying to smear us" But as we all know he does most of the smearing himself, by not addressing the issue at hand and blaming other for his flaws. Another response I got about my questioning of where is the IntLibber from Stray Underwood stated "And for people who do not understand, you have the option to be removed from search, everyone. So read up on the program and understand it before making pointless claims of frozen accounts." Well I do know the system very well. And I also know that when you take yourself out of search it is out of the web based search, not from under people in SL. I know this because I am not in search but you can still find me in search under people. Now to add to this, if you go under search "all" this is where it takes you out of search. Not entirely out of search but it says this on your profile page: "This resident has chosen to hide their profile from search." As you can see if you search my name "Jimmy Bligh" under all, the second search, since the first is your SL Profile. As you can see for IntLibber Brautigan, he does not show under "people" and the only way out of that is if you are suspended, frozen or banned. If you look under "all" you can compare my account with his and see that he has not taken his name out of search. Also to add to my findings, if you join any of his group on his profile, you will see his profile says he is in the group, but when you look in the group he is not there. There is no way of taking your self out of the group and still have it on your profile. You can only hide your groups from your profile. So with all my findings explained, I'm not here to jut bash IntLibber and say hes banned for non payment; I have shown the facts and proof. So my question is, what will happen to BNT, ACE and another holdings he has? Will this be another bad strike against the financial community? If this does happen will it just happen and be forgot about like Ginko, Tizzy, and Connell? I feel this is as bad as the Ginko, Tizzy and Connell wrapped up into one big explosion, since IntLibber is involved in all 3 parts of the SL Financial World, Land (BNT), Banking (BNTFRE) and Exchange (ACE).

With 13,500,000L$ in the BNT IPO, 4,231,583 L$ in deposits still outstanding on BNTF, and a couple million in ACE IPO and in ACE Deposits. This could be a big problem and the financial community could again get a black mark against it.

So far he has dodged the questions, and then turns it around and bashes anyone that asks questions of his publicly trade company or companies. And yes I understand times re tough in SL, but at least every other company is posting financials and keeping their shareholders in the loop of what is going on.

Thank you for your time and I'm looking forward to hearing every ones thoughts on this issue.

<![CDATA[ OP/Ed and Commentary re; ACE - Ancapistan Capital Exchange]]> http://slcapex.com/forums/topic/general/2154 This Forum is RESERVED for the posting of COMMENTARY, OPINIONS and EDITORIALS related to the Ancapistan Capital Exchaenge (ACE) operated in Second Life(tm) by the Public Figure (SL: Intlibber Brautigan).

As MODERATOR, here's a word of caution regarding our posting policy here. SL Capital Exchange will NOT tolerate any commentary that is libelous or a defamation of character. To that end, here's a brief legal description of the terms;

What Are Defamation, Libel and Slander?

Generally speaking, defamation is the issuance of a FALSE statement about another person, which causes that person to suffer harm.

Slander involves the making of defamatory statements by a transitory (non-fixed) representation, usually an oral (spoken) representation.

Libel involves the making of defamatory statements in a printed or fixed medium, such as a magazine or newspaper.

What Defenses Are Available To People Accused of Defamation?

The most important defense to an action for defamation is "truth", which is an absolute defense to an action for defamation.

A defense recognized in most jurisdictions is "opinion". If the person makes a statement of opinion as opposed to fact, the statement may not support a cause of action for defamation. Whether a statement is viewed as an expression of fact or opinion can depend upon context - that is, whether or not the person making the statement would be perceived by the community as being in a position to know whether or not it is true.

A defense similar to opinion is "fair comment on a matter of public interest".

Public Figures

Under the First Amendment of the United States Constitution, as set forth by the U.S. Supreme Court in the 1964 Case, New York Times v Sullivan, where a public figure attempts to bring an action for defamation, the public figure must prove an additional element: That the statement was made with "actual malice". In translation, that means that the person making the statement knew the statement to be false, or issued the statement with reckless disregard as to its truth.

The concept of the "public figure" is broader than celebrities and politicians. A person can become an "involuntary public figure" as the result of publicity, even though that person did not want or invite the public attention. For example, people accused of high profile crimes may be unable to pursue actions for defamation even after their innocence is established, on the basis that the notoriety associated with the case and the accusations against them turned them into involuntary public figures.

A person can also become a "limited public figure" by engaging in actions which generate publicity within a narrow area of interest.
