It's now almost a month since the CYB collapse, I assume that the CYB enquiry has concluded?

Will there will be a closing report highlighting the established facts?

Was there any evidence of collusion by AVIX staff?

Does SLCX agree that it is fraud?

Could SLCX address the following comment made by IntLibber on August 7th

"BNT Repos CYB Land For Shareholders
As the estate owner where Cybersyzygy's offices were located, I have reposessed their land in Hayek to protect those assets for the shareholders, pending an investigation and hearing. Should AVIX determine the CEO committed fraud, the land will be sold and proceeds divided among the shareholders of CYB."

Thank you,

CB

I have e-mails, telephone numbers, addresses, companies etc. Would you like me to post it here?

The worst part is the following:

DGD buys 10% of CYB out of IPO leveraging other assets.

Selling off other higher valued assets in particularly risky areas, DGD bought 10% of CYB out of IPO. The CEO is a good friend of Maelstrom Baphomet and a very trustworthy individual. In the verification process, a visual ID was used to identify the CEO that was uploaded from the real world, with their SL character in the background. It was cross-referenced with a state-government database. They are definitely, legitimately, who they claim. Judging by their website and their past projects, I am faithful they will be successful with enough effort. Their Prospectus was reasonably conservative.

May the winds be beneath your wings in business Fortune Rang, we are depending on you.

From the prospectus

Fortune Rang is a 10 year veteran of the business world, and in particular of website design and development, graphics design, logo and branding, marketing, and SEO, and brings her expertise to the job of CEO having operated HER RL company CyberSyzygy (CYB) for over 4 years.

The use of the term "HER" might have been made to deceive, however it seemed that Fortune considered herself a woman.

<![CDATA[ Re: Anybody home here?]]> http://slcapex.com/forums/topic/CYB/93
In response to IntLibber:
I understand your view on this, and for the most part I do agree. I just feel there can be a bit of a compromise. The recent policy change where new IPO CEO's will have to provide some government ID fills that role pretty well. Only a select few individuals will ever see it, and it's a lot more accountable than a name and rough location, while at the same time not being traceable by the public.
I could probably accept this going further and letting parts of that information become public in case of people wanting to persue, legally, but only if that person is willing to get into contact with the exchange using their own verified personal information to prove they're serious about it. And still, I wouldn't suggest showing everything from it... Passports especially are dangerous to hand around, there's an entire black market business on identity theft.

Although I wasn't a CYB share holder (The re-branded hosting service was easy to see through, as the people they hosted with branded their webpage with an ad... So the only thing I saw they had to offer was site building, and I wasn't sure if they were skilled enough for what they charge.), I still thank you for doing what you can to recoup for those who did hold shares.

Now for King:
I'm unclear as to how many companies here can even be called as such. I understand that Canadian law is very similar to US, so what I know of that is...
In Canada, you can operate a business that uses your RL name without ever having to register, up to a yearly value I believe. This is because, after making a certain amount of profit, you can be charged for GST (government sales tax). Up until then, you have to claim income off it, but that's all.
Beyond that, you need to register a name for your sole priprietorship (Difficult word, spelling may be off) or partnership. It is about a twenty minute process where you go down town to a government office and register through a machine. It will cost about 80 dollars, between getting the business name(number) and doing a names search to be sure you can have it in the first place.
Securing that name for international use is more of a pain that you usually don't have to go through, but if you don't, someone else can use your same business name elsewhere in the world - I think, same country even. If they decide to register it internationally first, you may be at risk of losing it. And incorporating - the business model emulated here if I'm not mistaken - is a little different, honestly I don't remember enough about it to detail here.

I'm sorry you don't think I'm deserving of a business because I value privacy and safety.
There are a lot of aggressive people in the world however. This doesn't just mean violent either. There are those who would try to get you charged with something inane to ruin your criminal record and give you some hardship.
There are those who will get into contact with people, either all at once or over time and talk about you, spreading rumors - true or otherwise - to ruin your name.
Then there's the classic stalker.
It doesn't take a business slight to trigger this sort of reaction either, it can be any number of motives. Political differences,
religious views, sexual preference, for example. We all exist far beyond the scope of our companies and investments here.
As much as I'd like to believe no one browsing this site are like that, I'd be an absolute fool, blind to human nature if I did.

And so, perhaps you'll be happy to know I won't ever be listing a company here. Provided I start one to begin with.

As for the holding cash/releasing it slowly note... I've heard rumor of the SLEC trying to get something similar passed. I do find it to be a relatively good idea, just in a much lower percentage than 50%. I imagine most companies go through the IPO process to gain the funds they need for something... So 50% reserve would force them to do one of a few things.
1: Wait months post IPO before they can get started, or at least make much progress.
2: IPO with either more released shares, or at a higher value per share, or both.

To Xavier:
A nice short reply, but with a strong point. Many names are unique enough that, first, last and location, I can track that persons phone number. From there, where they live.
Some are hopelessly common names exempt from that of course.

Arbitrage Wise has already rectified the refund matter with shareholders via a 1/1 share swap of AVIX shares which will be completed in the next two weeks. In case you missed it, please review the announcement at http://www.allenvestfinancial.com/home/story/SLR/463. This is above and beyond the land liquidation offer that has been made by BnT (http://www.allenvestfinancial.com/home/story/BNT/456).

Real-life details (in general) beyond first name, last name, and location will never be released publicly on this website. They are kept with exchange management and pulled only in the event that a CEO loses contact with shareholders. If you feel you have a legitimate need for the information, please IM me in world and I will provide you instructions and the CapEx fax number where you can make a written request for the information.

This is a safety issue. It is alarming that anyone would call for full name, address, ID, phone number, et cetera to be released to the shareholder list or SL public at large. Even in the event of fraud. I'm pretty sure this also skirts being a privacy/legal issue as well.

Requesting the information for CYB would be useless however, as was stated in the first paragraph. It is not available as it was not collected and verified as thoroughly as we now do. Sorry. We're still trying to get on our feet here and recover from the policies of former management.

I hereby call upon the exchange to release her RL details. She may have asked for confidentiality, but her agreement is now broken by her by her actions. I can tell people that she told me that she was a licensed real estate broker in Santa Rosa, California. She also has an affection for the ballet.

I call upon exchange officials to make her RL ID known, so that shareholders can consider their legal options, and she can be held accountable by the public. Real estate brokers sign very strict ethics contracts as part of their licensing. Committing fraud should count as a violation of that ethics contract. Do not let her get away with this crime.

Personal information such as phone# and address is for exchange management records and contact, not for public disclosure. (IMHO, Lindsay revealed too much but that's what make her trustworthy) IF you are taking thousands of dollars from the public, you need to make yourself credible and accountable.

Based on IntLibber saying, I'd say the exchange should hold 50% of IPO money, then release it slowly, eg. hold 30% in after first month, and so on. If the company need the money, then it is on loan base from the exchange with land rights or something.

Yes, stiff rules make good exchange for all of us!!!

This case is exactly why EVERY CEO's RL ID should be public. AVIX takes far more precautions than WSE does, and someone still walked away with piles of cash. The due diligence responsibility of exchange owners/managers should include doing RL background checks which the CEO pays for, and every IPO should reserve at least 5-30% of the IPO money in escrow, depending on the age of the avatar, their companys age, preexiting profitability, and degree of CEO RL ID disclosure, releasing the escrowed funds over a 3 month period.

FYI: As the estate owner where Cybersyzygy's offices were located, I have reposessed their land in Hayek to protect those assets for the shareholders, pending an investigation and hearing. Should AVIX determine the CEO committed fraud, the land will be sold and proceeds divided among the shareholders.

CEO information is not made public for that reason. We want to hold people accountable but we do not want to promote a violent and unsafe environment for anyone. While CEO information is required to management for listing, trust that it will not be made public as that is a privacy violation and not an ethically sound decision.
